It appears from the plearlings and evidence in this case, that on or about the 21st day of January, 1873, George W. Forbes sold and conveyed by general warranty deed to Abraham Rosenbery lots five and six in Forbes’ subdivision (an addition to the city of Omaha,) and received in payment therefor certain promissory notes amounting to $1,788.44, secured by a mortgage upon the said lots.
