LANSING, Judge.

Henry R. Loman appeals from the order of the district court summarily dismissing his application for post-conviction relief as untimely. We affirm.

FACTUAL AND PROCEDURAL BACKGROUND

Loman pleaded guilty to one count of grand theft by possession of stolen property, Idaho Code §§ 18-2403(4), -2407(1). The judgment of conviction was entered on October 26, 1998. Forty-three days later, on December 8, 1998, Loman’s counsel filed a notice of appeal from the judgment of conviction.
