A bill in equity filed by the plaintiff, the water company, asked for an injunction restraining the School District of the Township of Londonderry, from collecting tax upon certain land belonging to the plaintiff, consisting of three islands in the Susquehanna River. The plaintiff in the exercise of its chartered rights erected a dam in the Susquehanna River, and in doing so, backed up the water of the river and caused the banks of the islands to be flooded.
