This case is before the Court on Appellant Colorado West Transportation Co., Inc.’s Appeal from a decision by the United States Bankruptcy Court for the Northern District of Georgia. For the reasons set forth below, the decision of the Bankruptcy Court is REVERSED and REMANDED and; the Request for Oral Argument is DENIED.
