OPINION & ORDER

HUBEL, United States Magistrate Judge.

Plaintiff Michael W. Tucker brings this action against defendants Oregon Aero, Inc., MJD Innovations, LLC, Michael Den nis, 1-OPINION & ORDER and Jude Dennis. Plaintiff and defendants move for summary judgment. All parties have also consented to entry of final judgment by a Magistrate Judge in accordance with Federal Rule of Civil Procedure 73 and 28 U.S.C. § 636(c).

For the reasons explained below, I deny defendants’ motion and I grant in part and deny in part plaintiffs motion.
