This action was brought to recover from the State Bonding Fund on account of alleged breaches of duty on the part of the defendant Bonzer, as manager of the North Dakota Mill and Elevator Association. The Northern and Dakota Trust Company as a reinsurer under contract with the Bonding Fund, intervened. The case was brought to trial before the Honorable Daniel B. Holt, judge of the district court in and for the first judicial district without a jury.
