1Opinion of the Court

—In an action to recover damages for breach of contract, the defendant appeals from (1) an order of the Supreme Court, Orange County (Peter C. Patsalos, J.), dated January 18, 2000, which granted the plaintiffs motion for summary judgment and denied his cross motion for summary judgment dismissing the complaint, and (2) a judgment of the same court, entered May 15, 2000, which is in favor of the plaintiff and against him in the principal sum of $4,298.31. The notice of appeal from the order dated January 18, 2000, is also deemed to be a notice of appeal from the judgment (see, CPLR 5501 [c]).
