In February of 1977, Townview Nursing Home (“Townview” or “the Debtor”) instituted this adversary proceeding against the City of New York (“The City”). In its complaint, Townview alleged that it had filed a petition, in this Court, to effect an arrangement pursuant to the provisions of Chapter XI of the Bankruptcy Act of 1898, since repealed, on September 9, 1975.
