RICE, District Judge.

The legal problem involved in this appeal arose in a bankruptcy proceeding begun in the Western District of Oklahoma.

The bankrupt, Dayrold Eugene Davis, filed his voluntary petition on December 16, 1959. V. H. Carroll was elected as trustee. Prior to filing his petition in bankruptcy, Davis, who will hereafter be referred to as “Bankrupt,” executed two promissory notes payable to National Live Stock Credit Corporation, hereafter referred to as “National”; one for $11,161.53, dated May 27, 1959, and another for $5,500, dated August 4, 1959.
