As a result of a single car accident,, Hobart Donald Singleton, a guest passenger in an automobile owned and operated by David William Stoner, was killed. J. T. Robertson, Administrator of Singleton’s estate, plaintiff, instituted an action against Stoner, defendant, to recover damages for the wrongful death of his decedent. The motion for judgment alleged, among other things, that Stoner operated his vehicle in a “grossly negligent and careless manner, and in wanton disregard of the safety” of Singleton.
