MEMORANDUM OPINION

Before the court, is the joint motion of defendant Kamtek, Inc. (“Kamtek”) for summary judgment under Fed.R.Civ.P. 66 and for dismissal under Fed.R,Civ.P. 12(b)(6) (Doc. 11). For the reasons explained below, the motion to dismiss will be granted, mooting the motion for summary judgment.

BACKGROUND1
