On the 9th day of February, 1917, the plaintiff and the defendant entered into a contract in writing wherein and whereby the defendant agreed to manufacture, sell and deliver to the plaintiff one hundred pieces of woolens at the price of $1.75 per yard. Deliveries were to be'made during the months of May, June and July in the year 1917. ‘ The only deliveries made were ten pieces for which the plaintiff duly paid.
