The defendant, Andy H. Locken, was charged with the offenses of battery, aggravated assault and resisting a peace officer in violation of the provisions of sections 12 — 3 and 31 — 1 of the Criminal Code. (Ill. Rev. Stat. 1971, ch. 38, pars. 12 — 3 and 31 — 1.) He was found guilty in a bench trial in the circuit court of Cook County on the resisting charge and not guilty on the charge of battery.
