Plaintiffs in error here were plaintiffs in the trial court, and will be designated as in that court. They brought suit .against defendants in error in the form of trespass to try title to recover a 20-acre tract of land in Hardin county, Tex., Imown as the Herrington tract, being a part of the C. F. S. Jordit survey. They also sought to recover a large sum for the value of oil taken from the land in controversy. We will also designate the defendants in error as in the trial court.
