This case arose out of the issuance of a writ of scire facias sur municipal lien by the Township of Nether Providence, Delaware County. Defendants, who are the property owners in the appeal to this court, filed an answer containing new matter. The township replied. Defendants’ motion for judgment in their favor on the whole record was dismissed in an opinion by Sweney, J. The matter came on for trial before MacDade, P.
