Wells, J.:

The undisputed evidence in this case develops the following facts: In June, 1887, Ellen Fowler came to Manhattan, Kan., to visit her granduncle, James F. Gardner, and continued her visit until her aunt, Mrs. Gardner, died, some three weeks after her arrival. After her aunt’s death, at the request of her uncle, she remained with him as his housekeeper until his death, which occurred in July, 1890, and was paid therefor at the rate of $2.50 per Aveek until July 1, 1889, in full for her services to that date.
