WESLEY, Circuit Judge:
Defendant-Appellant Troy Gilliard appeals from a March 9, 2011 judgment of the United States District Court for the Southern District of New York (Sullivan, /.), following his guilty plea to conspiring to distribute and possess with the intent to distribute heroin, in violation of 21 U.S.C. §§ 841(b)(1)(C) and 846. The district court sentenced Gilliard principally to a term of 96 months’ imprisonment. Gilliard contends that the above-Guidelines sentence was procedurally unreasonable in light of Tapia v.
