[1.] In this assignment it is charged as error, that the presiding Judge held it unnecessary to set forth, in the bill of indictment against the slave, the opinion, in writing, of the Justices by whom he was committed, that he had committed a capital of-fence, and the other papers appertaining to the charge against him, and that, on the trial, it was unnecessary to prove them.
