WEXLER, District Judge.

This case was commenced in New York State Court, and was thereafter removed. Presently before the court is Plaintiffs motion to remand. For the reasons set forth below, the motion is granted.

BACKGROUND

In view of the fact that the existence of federal jurisdiction depends upon those allegations, they are recited here to make clear the basis for Plaintiffs claims.
