Supple, as stenographer of Department 1 of the District Court of the First Judicial District, to compel him to comply *185with the provisions of Section 372 of the Code of Civil Procedure, relative to writing out or printing exceptions taken ■during trial, and filing them with the clerk.
From the affidavit and answer of respondent to the alternative writ, it appears that during the days from November 22 to December 2, 1898, inclusive, a trial was had in Department 1 of the First Judicial District Court, at Helena, of a cause entitled “William Kranich v.…
