The plaintiff has appealed from a judgment in favor of the defendant in an action to recover five thousand dollars on a promissory note.

The note was executed by the defendant to the Boden Automatic Hammer Company, a corporation, in consideration for the purchase price of certain shares of the capital stock of the corporation, and was assigned to the plaintiff before maturity and for a valuable consideration.
