OTT, Judge.
On October 6, 1933, the defendant insurance company issued a policy to Harry Cloud wherein the company agreed, among other things, to insure said Cloud against loss resuíting from bodily injury sustained solely through external, violent, and accidental means, and, where the injury resulted in death, the company agreed to pay the sum of $400 to the beneficiary, the mother of the insured, who is the plaintiff in this case.
Harry Cloud was killed on February 3, 1935, by gunshot wounds inflicted by Otis Chase, at which time the policy was in effect. The suit is by the beneficiary to…
