This is an action for an injunction to restrain waste on the premises at the south-west corner of Thirty-ninth street and Sixth avenue, in the borough of Manhattan, city of New York. The plaintiffs seek to restrain the removal of. two brick piers on the Thirty-ninth street side of the said premises; the alteration of the ground floor, changing the partitions thereof, and restraining the making of any alterations which materially and permanently change the nature of the leased property.
