In this personal injury action brought by seaman John Morton pursuant to the Jones Act, 46 U.S.C. § 688, and general maritime law alleging negligence and unseaworthiness, defendant shipowner, Ber-man Enterprises, Inc. (“Berman”), appeals from a judgment of the Eastern District of New York by Judge Eugene H.
