MEMORANDUM OPINION AND ORDER

THIS MATTER comes before the Court on the Defendants’ Motion to Dismiss, filed February 7, 2012 (Doc. 16).1 The Court held a hearing on May 31, 2012. The primary issues are: (i) whether the Court should dismiss Defendant Sierra County Detention Center from the lawsuit where Plaintiff Juan Fabian Chavez concedes he is not alleging that its actions violated his constitutional rights; .
