Defendant was a tenant of plaintiff, from December 10,1918, to June 10, 1920, of premises consisting of the second floor and a part of the lower floor in a brick building or block owned by plaintiff. It entered into possession under a lease for one year at a rental of $215 monthly in advance for the first six months, and $190 per month in advance for the last six months, with privilege of a second year, on 60 days’ notice before the expiration of the first year.
