There were two appeals in this case, one being taken by the defendant from the judgment, and the other by the plaintiff from the order of the district court granting the defendant’s motion for a new trial, and each party filed a motion to dismiss the appeal of the opposite party, upon the ground that the appeal was not filed in the time required by rules two and three of this court. On the fifth day of March, 1886, a judgment was rendered in the case by the district court against the defendant, and on the tenth day of April following the defendant took his appeal therefrom to this…
