On May l, 1951, petitioner was tried by general court-martial on two charges, the first involving, violation of Article of War 61, 10 U.S.C. § 1533, absence without proper authority from his company at Pusan, Korea; and the second involving violation of Article of War 96, 10 U.S.C. § 1568. The latter charge included four specifications, each alleging a separate and distinct assault with a dangerous instrument, to wit: a knife.
