FLETCHER, Judge:

In September and October 1981, appellant was tried by a general court-martial composed of officer and enlisted members at the Marine Corps Recruit Depot, San Diego, California. Contrary to his pleas, he was found guilty of one specification of assault with a means likely to produce grievous bodily harm on Private P. E. Johnson, in violation of Article 128(b)(1), Uniform Code of Military Justice, 10 U.S.C. § 928(b)(1); one specification of assault consummated by a battery on Private B. A.
