The defendants were informed against and prosecuted for the murder of one Joseph Cicero. The charging part of the information was as follows:
“They, the said John McCann, James McCann and Michael McCann, in the county of King, in the State of Washington, on the twenty-first day of August, A. D. 1895, purposely and of their deliberate and premeditated malice killed one Joseph Cicero by then and there purposely and of their deliberate and premeditated malice, shooting and thereby mortally wounding the said Joseph Cicero, with a revolver pistol,…
