This appeal was submitted October 27. The decree was reversed November 3. The Chief Justice at that time wrote a dissenting opinion, concurred in by Mr. Justice McHANEY and Mr. Justice HOLT. On petition for rehearing four members of the court think the former determination was erroneous. Mr. Justice FRANK G. SMITH, Mr. Justice HUMPHREYS, and Mr. Justice MEHAFFY adhere to the opinion of November 3, which they are handing down as expressive of their views.
