Appeal from the District Court of Limestone. Tried below before the Hon. S. R. Frost. The indbtment charged the appellant with the murder of Peter Milstead, in Limestone county, Texas, on the seventh day of September, 1874. This trial, which was had at the November term, 1887, of the district court of Limestone county, resulted in the conviction of the appellant for manslaughter, and the assessment against him of a term of three years in the penitentiary as punishment.

This is a conviction for manslaughter, with the punishment fixed at three years confinement in the penitentiary.
Appellant was tried on the thirty-first day of October, 1887. *242The court adjourned on the eighteenth of November, 1887. Counsel for appellant presented to the district attorney, for his approval, a statement of facts, on the thirtieth day of November, 1887, twelve days after the adjournment of the court.
