PARKER, Circuit Judge.
This is an appeal from a conviction of pérjury. At October term, 1937 of United States District Court at Big Stone Gap, Virginia, the defendant John Goins and *148wife were tried under an indictment charging them with facilitating the transportation1, concealment and sale of morphine hydrochloride in the preceding April in violation of Sec. 174, Title 21 of the United States Code, 21 U.S.C.A. § 174.
