KRUCKER, Chief Judge.

This is an appeal from a dismissal' with.out a hearing of a petition of habeas corpus; filed by appellant on March 3, 1972.

The facts are briefly as follows, ©re November 17, 1965, appellant was found guilty of illegal sale of marijuana and! sentenced to imprisonment “for a period of not less than fifteen nor more than twenty years, time to run from this date.” On December 22, 1965 he arrived at the state penitentiary.
