— This appeal presents two issues, i.e., whether the judgment of the trial court is supported by sufficient evidence and whether the trial court erred in sustaining appellee’s motion for summary judgment.

Plaintiff-appellant filed a paternity suit on December 19, 1972, against the defendant-appellee. Thereafter, on March 12, 1973, the depositions of the respective parties were taken and on April 27, 1973 the appellee filed his motion for summary judgment under Ind.
