Appeal by the defendant, Frank E. Anderson, from an order of the Supreme Court, made at the New York Special Term and entered in the office of the clerk of the county of New York on the 31st day of December, 1907, directing the defendant to make and serve a bill of particulars of the defenses contained in his amended answer.

The action is brought to recover the purchase price of 386 shares of the capital stock of the Manufacturers’ Commercial Company, which, it is alleged, was purchased and paid for by the plaintiff pursuant to an agreement between the plaintiff and defendant, whereby it was to be purchased by them on the understanding that the defendant was to save the plaintiff harmless and to reimburse the plaintiff the amount paid- for the stock and take over the same.
