MURNAGHAN, Circuit Judge:

On October 27,1980, a three count indictment was returned in the United States District Court for the Middle District of North Carolina. Count One charged appel Iant Jack Randall MacCloskey and others 1 with conspiracy to murder a federal agent, Drug Enforcement Administration Special Agent Skaggs, in violation of 18 U.S.C. §§ 1114 and 1117.
