The defendant in error, Damd J. Odell, brought this suit before a justice of the peace of Iowa county, against these plaintiffs in error, Michael Oassin and Eleaser Smith; who, feeling themselves aggrieved by the judgment of the justice, applied to a supreme court commissioner of said county for the allowance of a writ of certiorari to said justice, to remove the judgment and all the proceedings in the case, to the district court of said county for revision and correction.
