Now before the Court are the parties’ joint motions for: (1) entry of judgment *270under Rule 68 of the Federal Rules of Civil Procedure in Plaintiffs’ favor,- or, in the alternative, (2) leave'to file an interlocutory appeal to the United States Court of Appeals for the Second Circuit pursuant to 28 U.S.C. § 1292(b). (Doc. Nos. 71, 77, 81.) For the reasons set forth below, the motions are denied.
