MEMORANDUM OPINION
SIRICA, District Judge.
I. BACKGROUND
This is a bitterly contested malpractice action in which plaintiff, Kay Stanton Payne, seeks to recover damages from Dr. Daniel M. Howard and Greater Southeast Community Hospital. The complaint basically alleges that Dr. Howard performed a sagittal split osteotomy on plaintiff in a negligent manner and without her informed consent. The complaint also alleges that the Hospital was negligent by failing to provide sterile facilities and capable personnel to care for plaintiff after the surgery was performed.
