OPINION

PAGE, Justice.

This case arises as a result of injuries sustained by Shawn Lubbers when his snowmobile encountered open water, began to sink, and Lubbers was struck from behind by a snowmobile driven by Greg Anderson, while riding on the partially frozen St. Louis River. Lubbers and his wife, Lora, commenced this action in Hennepin County District Court against Anderson.
