Appeal from a judgment of the County Court of Otsego County (Mogavero, Jr., J.), rendered June 5, 1989, upon a verdict convicting defendant of the crimes of assault in the second degree and reckless endangerment in the second degree (two counts).

In December 1988, defendant was indicted and charged with two counts of attempted assault in the first degree and two counts of reckless endangerment in the first degree. The charges arose out of an incident that occurred on October 16, 1988 near the intersection of State Route 23 and James F. Lettis Highway in the Town of Oneonta, Otsego County. The…
