OPINION OF THE COURT

The indictment, which was filed September 3, 1998, charges the defendant with two counts of murder in the second degree, relating to the shooting death of Jeffrey Smith on January 5, 1998. The defendant was arraigned on September 8, 1998, and at that time his counsel was provided with a copy of the indictment. In addition, a notice, which was attached to the indictment, and served pursuant to CPL 710.30, referenced two previous identification procedures.
