Matthews, Justice,
(charging jury.) This action is brought hy the Waynesville iNlational Bank, as the owner and holder of a promissory note which reads as follows:
“ $10,000. LEBANON, Onto, April 15, 1878.
“ One year after date, we, or either of us, promise to pay to the order of the treasurer of the Miami Talley .Railway Company ten thousand dollars, for value received.”
It is signed by Samuel Irons, William I. Dill, Daniel Perrine, F. Hutchinson, William Morlatt, and William V. Bone. On the back of it is the following indorsement: “Demand and notice of protest waived. W. B. Sellers, Troas. M.…
