This is a taxpayer’s action brought to obtain a judgment declaring illegal and setting aside a contract between the board of improve*178ment of the town of New Utrecht in Kings county and the Kings . County Gas and Illuminating Company.
The contract bears date December 26,. 1889, and by its provisions the gas company agreed, during the term specified, to erect and maintain in said town, on land to be purchased or leased, a gas tank and all necessary appurtenances for the storage and supply of illuminating gas sufficient to supply the entire town, and to lay all necessary mains and…
