From Kosciusko Circuit Court; Francis E. Bowser, Judge. Action by Effie Hunter, administratrix of the estate of Joseph Hunter, deceased, against the Chicago and Erie Railroad Company. From a judgment for plaintiff, the defendant appeals.

On January 22, 1913, at about 6:30 p. m., Joseph Hunter, while attempting to walk across the tracks of appellant’s railroad at an intersection of such tracks with a public street in the town of Leiter’s Ford, in Fulton county, Indiana, was run over and killed by one of appellant’s freight trains. His widow, *161Effie Hunter, was appointed administratrix of his estate, and as such brought an action against appellant in the Fulton Circuit Court to recover damages for herself and the minor children of said decedent, charging that decedent’s death was caused by appellant’s negligence.
