Petitioners commenced this CPLR article 78 proceeding to annul the Town Board’s adoption of the Town of East Hampton Comprehensive Plan dated May 6, 2005 and Local Law No. 16 (2005) of the Town of East Hampton which amended article XII of chapter 255 (Zoning) of the Code of the Town of East Hampton. Petitioners contend the comprehensive plan and the local law were adopted in violation of the State Environmental Quality Review Act (SEQRA).
