(dissenting) — On the 30th day of June, 1937, Jennie A. Yancey as guardian of the property of Merritt Milton Yancey, a minor, filed in the District Court of Floyd County, Iowa, in the matter of the estate of Kate G. Ellis, deceased, an application to establish the rights of her ward in and to the property of said estate under and by virtue of the following residuary clause contained in the first codicil to the last will and testament of testatrix, Kate G.‘ Ellis, which reads as follows:
