This is a suit to recover delinquent employer contributions to employee benefit plans under the Employee Retirement Income Security Act of 1974 (“ERISA”). The plaintiffs, Local Union No. 17 of the Sheet Metal Workers’ International Association (“Local 17”) and the trustees of an employee benefit fund maintained by Local 17, seek to collect unpaid contributions due and owing to the fund pursuant to a collective bargaining agreement between Local 17 and May Engineering Company (“May Engineering”).
