Appellant, Cleve Morris, was convicted on a charge that he did have in his possession about 7*4 gallons of whisky, with the unlawful intent to sell the same and his punishment fixed at 60 days in jail and a fine of $150. From the judgment entered on the verdict, he appeals.

The assignments of error relate to the rulings of the court in the admission and exclusion of evidence and the sufficiency of the evidence taken as a whole to sustain the verdict.
